Jean Domanski is one of the few EB-2 NIW attorneys in the USA who is also a member of MENSA and has an M.A. in Communications.
Ms. Domanski earned her juris doctor at American Heritage University School of Law. She also has a Master of Arts in Communications from Pepperdine University, where she was also a Graduate Teaching Assistant. Like many of her clients, she had to write and defend a thesis. Ms. Domanski currently lives in Los Angeles but is originally from Philadelphia. When she is not practicing law, you might find her at book club or driving her teenager around. |

WHAT IS A NATIONAL INTEREST WAIVER (EB2 NIW)?

In 2016, a court case called Matter of Dhanasar 26 I&N Dec. 884 (AAO2016) changed the criteria for the EB-2 Second Preference green card seeking a National Interest Waiver, or NIW.
To qualify for an NIW, you must have an advanced degree, or a bachelor’s degree and many years of progressive experience in your field.
The three main criteria that you must demonstrate to the United States Citizenship and Naturalization Service (USCIS) are:
1. Your proposed endeavor in the U.S. has substantial merit and national importance
2. Well-positioned to achieve your goals in the U.S.
3. On balance, it would benefit America to waive the job offer and labor certification requirement.
